Her Lawsuit Against the Recall
Tina Fredericks asked a court to stop the recall petition from circulating. The petition was approved and is circulating. The next hearing is December 1, 2026.
July 2, 2026: She Files Suit
Fredericks filed a petition in Los Angeles Superior Court asking the court to bar county election officials from approving and allowing the recall petition to circulate. She argues that the petition contains false and misleading statements about her role in attempting to close schools. She is representing herself.
Her original filing included 124 unidentified "Doe" parties, matching the number of residents who signed the notice of intention to circulate the recall petition.
September 2026: The Does Are Dropped
On September 2, after public condemnation for suing her own constituents, Fredericks filed an amended petition that dropped the 124 recall signers she had originally named as "Doe" defendants. She claimed that naming them was a paperwork snafu. A September hearing was postponed because she failed to give timely notice.
October 13, 2026: The Judge Weighs In
At the October 13 Trial Setting Conference, Judge Tiana J. Murillo:
- concluded that Fredericks had once again failed to serve notice on Respondent Los Angeles County;
- said the County's decision to approve and circulate the recall petition was not reviewable by a court, and was moot because the petition had already been approved and was circulating;
- indicated that Fredericks' petition did not state a valid basis for relief, and noted broader constitutional issues with it;
- said Fredericks would need the Court's permission to file any further amendment.
Judge Murillo explained to Fredericks that it is not the Judge's "job to shepherd you through" the litigation process.Colorado Boulevard, October 13, 2026
Because counsel for Los Angeles County had not received notice and was not present, the Court reset the Trial Setting Conference for December 1, 2026, and again ordered Fredericks to serve notice on the County's counsel.
Her Position
Fredericks denies the allegations in the recall petition. She has said that no more than two or three of the seven board members participated in any communication, and that "Consolidation 2027" was a collection of personal notes that was never circulated.
